fundraising registration requirements. Other states may require
a different form of registration depending on your organization's

Who Must File?
For the most part, any nonprofit organization that solicits charitable gifts
in any amount from residents of a state is required to register with that state.
There are some exemptions varying from state to state for membership organizations
or for those that do not meet certain income levels. |

While the definition of a "charitable solicitation" differs
in many states, a charitable solicitation generally
includes any request of any kind for a charitable contribution.
An in-person or telephone or email solicitation is encompassed
in the general definition of a charitable solicitation, as well
as the distribution of a newsletter or brochure which solicits
a gift.
When an organization
actively solicits residents of a given state via an Internet website, or should
the organization receive contributions from within another state on a repeated
and ongoing basis, then the organization must register with that state.
What Is Required?
At this writing there are 10 states that have no statutory
regulations in place for 501(c)(3) organizations that solicit
private donations in their borders. 3 states have their own forms
and requirements. The other states and the District of Columbia
use the 3 page Unified Registration Statement (URS) as an alternative
to state-specific forms. However, each of those states has a
different fee scale and requires a different set of supporting
documents, including state-specific forms, to be submitted together
with the URS. Required documents may include:
- A general information form.
- Financial statement.
- 990 tax returns.
- Articles of incorporation.
- Information about officers and directors.
- Notarized signatures.
- By-laws
- IRS 501(c)(3) determination letters.
Reporting and renewal dates vary from state to state.
